1. INFORMATION WE COLLECT
We collect the following personal information and may have collected such information in the past 12 months:
- Identifiers, which include your name, postal address, email address, unique personal identifiers, online identifiers, IP address, account name, driver’s license number*, social security number*, vehicle identification number and other similar identifiers. We collect identifiers such as name, address and contact information in order to provide you with our products and services. We may also collect your driver’s license* in connection with the use of certain products. In addition, we obtain identifiers such as user name or ID*, passwords* and similar credentials when you create an account with us to access our services or when you communicate with us via social media, as well as your IP address and unique device identifiers when you visit our websites or use our mobile apps.
- The following categories of personal information described in California Civil Code § 1798.80(e): (1) the Identifiers listed above; (2) signature, (3) telephone number, (4) payment information* (which may include bank account number and/or credit or debit card number), (5) automobile insurance policy number, (6) information obtained in connection with a credit check (if applicable in connection with services obtained from us), including financial information and education, employment and employment history.
- Commercial information, including records of products and services obtained from United Rentals and information about your purchasing preferences.
- Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding your interaction with our websites, mobile apps and advertisements.
- Geolocation data* in the form of the location of our rental equipment and devices. This includes the geolocation of the rental equipment and devices during your use of them.
- Audio information from calls made to our customer service centers or local stores, which may be recorded, video information in the form of CCTV at our local storefronts and electronic information in the form of Internet or other electronic network activity information as described above.
- Professional or employment-related information, in the form of business contact information and as noted above in connection with credit checks performed in connection with certain services.
- Inferences drawn from (1) the information we collect when you visit our Sites or use our mobile apps when you use our products or services, including our training academy, (2) information we collect, including through third-party suppliers, regarding content and other data posted on the Internet (such as public locations on the Internet) and (3) information about consumer preferences and behavior that we collect on our websites and mobile apps or purchase from third parties in order to create a profile about a consumer reflecting the consumer’s preferences, characteristics, predispositions, behavior and attitudes.
- Information provided in response to surveys.
- Information provided when submitting any reviews or comments regarding our products or services.
The information marked with an asterisk (*) above is considered “sensitive information” under the California Consumer Privacy Act. Unless otherwise stated, we intend to retain the above information for as long as reasonably necessary to complete the purpose(s) for which the personal information was collected.
2. HOW WE COLLECT INFORMATION
We collect personal information that you provide to us, including information you submit to us when you use the Sites or our mobile apps, rent equipment or purchase other services from us. As you navigate through and interact with the Sites or use mobile apps, we may use automatic data collection technologies to collect certain information about your equipment, online activities and browsing actions and patterns. We may collect this information directly or through third parties, including operating systems and platforms, social networks, internet service providers, data analytics providers or advertising networks.
3. COOKIES AND LINKED SITES
The technologies we use for automatic data collection on the Sites or our mobile applications include cookies and web beacons. A cookie is a small text file placed on your device. A web beacon is a small electronic file (e.g., clear gifs, pixel tags and single-pixel gifs) with a unique identifier that is used to understand browsing activity. We use data collected through these technologies, which we may supplement with other information such as location, to help us improve the Sites and to deliver a better and more personalized service.
Third-party cookies. Some content or applications on the Sites, including advertisements, are served by third parties, including advertisers, ad networks and servers, content providers, social media networks and application providers. These third parties may use cookies, alone or in conjunction with web beacons or other tracking technologies, to collect information about you when you use the Sites. 4. HOW WE USE INFORMATION
We may use personal information we collect to:
- Provide you with the Sites as well as with information, products or services that you request from us.
- Complete transactions, including your rental or purchase of products and services.
- Provide customer and account services, such as notices regarding products and services or your account/subscription, including expiration and renewal notices.
- Comply with applicable laws, cooperate with investigations by law enforcement, and/or pursue our legal rights, including performing and enforcing our contractual obligations and rights, such as billing and collection.
- Evaluate and improve our products and services and/or develop new products or services.
- Tailor our marketing and advertising to you.

We may disclose aggregated information about our users and information that does not identify any individual, without restriction.

- Contractors, service providers and other third parties we use to support our business and provide you with our products and services. These include but are not limited to companies that process, store or transmit credit card information and who are bound by contractual obligations to keep personal information confidential and secure, and to use it only for the purposes for which we disclose it to them.
- Our customers in connection with services we provide to them, including information related to driver and operator behaviors that occur during the use of the rented or purchased equipment.
- As noted in our Rental and Service Terms, telematics data may be available to subsequent users of equipment.
- Buyers or other successors in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding in which personal information held by us is among the assets transferred.
- Government entities or other parties to comply with court order, law or legal process, including responding to a government, court or regulatory request.
- Government entities, third-party cybersecurity experts or other parties as necessary and appropriate to ensure the security and integrity of our networks, or otherwise protect the rights, property or safety of United Rentals, our customers or others.
- Third-party entities to enforce or apply our terms of use and other agreements or otherwise protect or assert our legal rights, including for billing and collection purposes.
We may also disclose your personal information with your consent or for any other purpose disclosed by us when you provide the information.

6. CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

If we have sent you a promotional e-mail, you may send us a return e-mail asking to be omitted from future e-mail distributions. This opt out does not apply to information provided to United Rentals as a result of a product purchase, warranty registration, product service experience or other transactions.
- Targeted Advertising. If you do not want us to use information that we directly or indirectly collect or that you provide to us to deliver our advertisements according to our advertisers' target-audience preferences, you can opt-out by contacting our Privacy Officer (see How to Exercise These Rights or Contact Us below for details on how to contact our Privacy Officer). For this opt-out to function, you must have your browser set to accept browser cookies. 7. CHILDREN UNDER THE AGE OF 13
The content of the Site is not targeted to or intended for children under 13 years of age. United Rentals does not market products or services to this age group and does not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Site or on or through any of its features or register on the Site, make any purchases or rentals through the Site or provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact our Privacy Officer (see Contact Us below for details on how to contact our Privacy Officer).
8. YOUR PRIVACY RIGHTS
Residents of California, Virginia, Colorado, Utah and Connecticut may have the right to: (1) know what personal information we collect, use, disclose, and sell; (2) request that we delete your personal information; (3) access and obtain a copy of your personal information that we collect; (4) request correction of inaccurate personal information; (5) opt out of targeted advertising; or (6) limit the use and disclosure of certain sensitive information. In addition, we may not discriminate against you for exercising any of your rights. We will honor your request to the extent required by applicable law and will make a good faith effort to honor your request in all other cases.
If you disagree with our response to your request, you may appeal the request by submitting supporting documentation to privacy@ur.com.
With respect to deletion requests, we cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you have a UnitedRentals.com account, you can review and change your personal information by logging into the Site and visiting your account profile page and updating your information. Please note that this will not update your customer account with us; this will only update your Site account. Please note that we may take steps to verify your identity before granting you access to information or acting on your request to exercise your rights, as required or permitted by law. We may limit our response to your exercise of the above rights as permitted by law.
You may designate an authorized agent to exercise the foregoing rights on your behalf. An agent may be an individual or a business entity registered with your Secretary of State. To designate an authorized agent, you must provide the agent with written permission to submit the request. We may still require you to verify your identity directly (subject to certain exceptions). We may refuse a request if the agent does not provide adequate proof of their authorization.
10. SALES OF PERSONAL INFORMATION
When we share information for purposes of targeted advertising or advertising networks, such sharing may be considered a “sale” of information under some state laws. You may request to opt out of such sharing of information.
11. DO NOT TRACK
Please note that our Sites and mobile apps are not designed to respond to "do not track" requests from Web browsers.
12. DATA SECURITY
We have implemented measures designed to secure your information. For example, we require our payment processing merchants to comply with the Payment Card Industry Data Security Standards. Moreover, we require that any third parties that process your information on our behalf comply with a comprehensive set of security requirements. These passwords help us verify your identity before granting access or making corrections to any of your personal information. EUROPEAN ECONOMIC AREA ADDENDUM
If you are a resident of the European Economic Area (“EEA”), the following additional provisions apply to how we treat your personal information. The provisions of this EEA Addendum prevail over conflicting provisions in the Privacy Policy.
1. How We Use Information
We use the following legal bases for the processing of your personal information:

This Terms of Use Agreement ("Terms of Use") applies to your use of the United Rentals websites located at https://www.ur.com and https://www.unitedrentals.com, https://www.unitedacademy.ur.com, https://urcontrol.ur.com, https://used.unitedrentals.com/ and https://totalcontrol.ur.com (collectively, the "Site"), whether directly or through mobile access using compatible and supported wireless devices. The Site is the property of United Rentals, Inc. (together with its affiliated companies, "United Rentals").
BY ACCESSING AND/OR USING THE SITE, YOU ACCEPT AND AGREE TO THESE TERMS OF USE ON YOUR BEHALF AND, IF YOU ARE ACCESSING OR USING THE SITE ON BEHALF OF ANOTHER PERSON OR ORGANIZATION, ON BEHALF OF SUCH PERSON OR ORGANIZATION (collectively, “you”). United Rentals reserves the right, at its sole discretion, to change, add or remove portions of these Terms of Use, at any time. All media (downloaded or samples), software, text, images, graphics, user interfaces, music, videos, photographs, trademarks, logos, artwork and other content on the Site (collectively, "Content"), including but not limited to the design, selection, arrangement, and coordination of such Content on the Site, is owned or licensed by or to United Rentals, and is protected by copyright, trade dress, and trademark laws, and various other intellectual property rights laws. Except as expressly provided in this Terms of Use, no part of the Site and no Content may be reproduced, recorded, retransmitted, sold, rented, broadcast, distributed, published, uploaded, posted, publicly displayed, altered to make new works, performed, digitized, compiled, translated or transmitted in any way to any other computer, website or other medium or for any commercial purpose, without United Rentals' prior express written consent. Except as expressly provided herein, you are not granted any rights or license to patents, copyrights, trade secrets, trade dress, rights of publicity or trademarks with respect to any of the Content, and United Rentals reserves all rights not expressly granted hereunder. United Rentals expressly disclaims all responsibility and liability for uses by you of any Content obtained on or in connection with the Site.
UNITED RENTALS, the United Rentals' elliptical design and other trademarks used on the Site, are registered trademarks or service marks of United Rentals. All other trademarks or service marks are property of their respective owners. The use of any United Rentals trademark or service mark without United Rentals' express written consent is strictly prohibited.
User Content and Submissions, Licenses
You understand and agree that all information, data, text, software, music, sound, images, photographs, graphics, video, advertisements, messages, trademarks, logos, artwork or other materials submitted, posted or displayed by you on or through the Site ("User Content") is solely your responsibility. United Rentals makes no claims of ownership or control over any User Content. You or a third party licensor, as appropriate, retain all patent, trademark and copyright to any User Content you submit, post or display on or through the Site and you are responsible for protecting those rights, as appropriate. By submitting, posting or displaying User Content on or through the Site, you grant United Rentals a perpetual, worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish such User Content through the Site and as part of United Rentals’ services. In addition, by submitting, posting or displaying User Content which is intended to be available to other members of the general public, you grant United Rentals a perpetual, worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish such User Content for the purpose of promoting the Site, United Rentals, and/or their respective services. United Rentals will discontinue this licensed use within a commercially reasonable period after such User Content is removed from the Site. United Rentals reserves the right to refuse to accept, post, display or transmit, or to disable or terminate any post, display, or transmission of, any User Content in its sole discretion, but shall have no obligation to do so, and no obligation to monitor any User Content.
You agree that you will not use the Site in a manner that, or submit any User Content that: (i) violates any federal, state, provincial, local, or international law or regulation; (ii) may, in our sole discretion, contribute to the harassment, exploitation, or harm of any person, including activities that may be defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable; (iii) may expose United Rentals to any liability, including by posting any material that infringes on or misappropriates the intellectual property rights of third parties; (iv) may be harmful to others, United Rentals’ operations, or Untied Rentals’ reputation, including offering or disseminating fraudulent goods, services, schemes, or promotions (e.g. get-rich-quick schemes, Ponzi or pyramid schemes, phishing, or pharming) or engaging in other deceptive practices; or (v) involves content or other computer technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including viruses, Trojan horses, worms, or other malware.
If you post User Content in any public area of the Site, you also permit any user to access, display, view, store and reproduce such User Content for personal use. Subject to the foregoing, the owner of such User Content placed on the Site retains any and all rights that may exist in such User Content. United Rentals may, in its sole discretion, review and remove any User Content for any reason, such as but not limited to User Content that violates these Terms, violates intellectual property and/or other laws, rules or regulations, is abusive, disruptive, offensive or illegal, violates the rights of, or harms or threatens the safety of, users of the Site or third parties, or is inconsistent with the policies or positions of United Rentals and/or the Site. United Rentals reserves the right to expel you and/or any other users and prevent their further access to the Site and/or use of United Rentals services for posting User Content that is subject to termination or for otherwise violating the Terms or applicable laws, rules or regulations. United Rentals may take any action with respect to User Content that it deems necessary or appropriate in its sole discretion if it believes that such User Content could create liability for United Rentals, damage United Rentals’ brand or public image, or cause United Rentals to lose users or (in whole or in part) the services of its ISPs or other vendors or suppliers.
United Rentals does not represent or guarantee the truthfulness, accuracy, or reliability of User Content, derivative works from User Content, or any other communications posted by users, and does not adopt or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk.
United Rentals reserves the right to restrict the number of posts, e-mails, transmissions, or other messages which a user may send or display to other users to a number which United Rentals deems appropriate in its sole discretion.
2. REGISTRATION, CUSTOMER ACCOUNT AND USE OF SITE
Certain services offered on or through the Site require you to first open an Account. You are responsible for maintaining the confidentiality of your Account information, including your password, and for all activity that occurs under your Account. You agree to notify United Rentals at the address set forth in Section 4 below immediately of any unauthorized use of your Account or password, or any other breach of security. You may be held liable for losses incurred by United Rentals or any other user of the Site due to someone else using your password or Account. You may not use anyone else's password or customer account at any time. You may not attempt to gain unauthorized access to Accounts or the Site. Should you attempt to do so, assist others in making such attempts, or distributing instructions, software or tools for that purpose, then your customer Account will be terminated, and United Rentals may seek other relief. You agree to provide us with accurate, current and complete information about yourself and your billing information. You may update any of your Account information, designate a different credit card to be billed, or change the applicable expiration date on your currently designated credit card, by editing your Profile. You may not use any automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy, probe, test or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or any of the systems or networks comprising or connected to the Site.
You also agree that United Rentals may, in its sole discretion and without prior notice to you, terminate your access to the Site and your Account for any reason, including without limitation: (1) attempts to gain unauthorized access to the Site or assistance to others' attempting to do so, (2) overcoming software security features limiting use of or protecting any Content, (3) discontinuance or material modification of the Site or any service offered on or through the Site, (4) violations of this Terms of Use, (5) failure to pay for purchases or rentals, (6) suspected or actual copyright infringement, (7) unexpected operational difficulties, or (8) requests by law enforcement or other government agencies. You acknowledge that the Rental and Services Terms may change [in whole or in part] over time and agree to be bound by such version of the Rental and Services Terms in use at the time of each rental, sale or service transaction in the jurisdiction where the purchase or rental occurs. 7. METHODS OF PAYMENT, CREDIT CARD TERMS AND TAXES
All payments must be made by VISA, MasterCard, Discover, American Express, certified check or cashier's check, or, in certain cases with prior approval, purchase order, personal check or business check. We currently do not accept cash, personal or business checks, PayPal or any other payment form. Your card issuer agreement governs your use of your designated card, and you must refer to that agreement and not this Terms of Use to determine your rights and liabilities as a cardholder. YOU, AND NOT UNITED RENTALS, ARE RESPONSIBLE FOR PAYING ANY UNAUTHORIZED AMOUNTS BILLED TO YOUR CREDIT CARD BY A THIRD PARTY. If United Rentals does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by United Rentals or its agents. You are responsible for paying any governmental taxes imposed on your purchases and rentals, including, but not limited to, sales, use or value-added taxes. United Rentals shall automatically charge and withhold the applicable tax for orders to be delivered to addresses within any states, provinces, territories or localities that it deems is required.
8. ORDER ACCEPTANCE POLICY
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell or rent. United Rentals reserves the right at any time after receipt of your order to accept or decline your order for any reason. United Rentals further reserves the right any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. Your order will be deemed accepted by United Rentals upon our delivery of products or services that you have ordered. We may require additional verifications or information before accepting any order.
9. NO RESPONSIBILITY TO SELL OR RENT MISPRICED PRODUCTS OR SERVICES
United Rentals shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. United Rentals shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. Upon receipt of the appropriate information identified above, United Rentals will investigate the complaint, during which time United Rentals, at its sole discretion and without any legal obligation to do so, may temporarily remove the challenged material from the Site, notify the posting party it will lock down the posting party's account, if any, and/or, if the Allegedly Infringing Material is stored on a United Rentals server, temporarily remove or deny access to the Allegedly Infringing Material.

In all cases involving claimed copyright infringement, and where appropriate in United Rentals’ sole discretion regarding claimed trademark infringement, upon receipt of a Counter Notification as described above, United Rentals will promptly provide the complaining party with a copy of the Counter Notification, and inform the complaining party that United Rentals will replace the removed material, or cease disabling access to it, in 10 business days. United Rentals will replace the removed material and cease disabling access to it in not less than 10, nor more than 14, business days following receipt of the Counter Notification, unless United Rentals first receives notice from the complaining party that the complaining party has filed an action seeking a court order to restrain the alleged Infringer from engaging in infringing activity relating to the material on the Site.

17. GENERAL
No delay or failure to take action under these Terms of Use shall constitute any waiver by United Rentals of any provision of these Terms of Use. If any provision of these Terms of Use is invalid or unenforceable under applicable law, it is, to that extent, deemed enforceable to the fullest extent possible (and severable in the event such provision is completely unenforceable) and the remaining provisions of these Terms of Use will continue in full force and effect.
